As you may be aware, there will be new reporting requirements for outpatient therapy services beginning 1/1/13.The Middle Class Tax Relief and Jobs Creating Act of 2012 section 3005(g) amended section 1833(g) of the Social Security Act to require a claims-based data collection system. The system will collect data on beneficiary function during the course of therapy services in order to better understand patient conditions, outcomes, and expenditures. This data collected from the functional reporting will be used in developing an improved payment system for part B outpatient therapy services. Nov 08, 2012NASL ACTION ALERT - Therapy Cap Exceptions Process Expires December 31st
There are enough changes in the industry that will effect patient care and staffing as it is. Please direct everyone to tell their representatives that they need to extend the exception process as often as they can. Think of ways to get the facility employees on the website so they can send letters as well. We really need to push harder than ever before. There is so much legislation change out there now, this will get overlooked if we let it. You may need to hold down your “control” button while clicking on the link to make it work. The “take action” link takes you to a screen that has a letter already generated. You only need to fill in the boxes to send the letter. It takes about 30 seconds and the letter will go to all your representatives at the same time....Learn more »

Oct 30, 2012Settlement Reached to End Medicare’s “Improvement Standard”
Attorneys from the Center for Medicare Advocacy, Vermont Legal Aid and the Centers for Medicare & Medicaid Services (CMS) have agreed to settle the “Improvement Standard” case, Jimmo v. Sebelius. A proposed settlement agreement was filed in federal District Court on October 16, 2012. When the judge approves the proposed agreement, a process that may take several months, CMS will revise the Medicare Benefit Policy Manual and other Medicare Manuals to correct all suggestions that Medicare coverage is dependent on a beneficiary “improving.” New policy provisions will state that skilled nursing and therapy services necessary to maintain a person’s condition can be covered by Medicare. Oct 30, 2012Part B Therapy: More Stormy Weather Ahead!
The final mandated report on “Improving Medicare’s Payment System for Outpatient Therapy Services” is due on June 15, 2013. However, Congress has asked MedPAC to forward the recommendations in early- November so they are relevant to the discussion that will take place during the Lame-Duck session, when Congress is expected to consider Medicare extenders, which includes extending the therapy cap exceptions process that expires on December 31, 2012.
